General

Listed below are the Terms and Conditions of Lake 86 a trading name of COTSWOLD WATER PARK HIRE LTD. No alterations or variations to these Terms and Conditions shall be binding unless agreed in writing.
Lake 86 reserves the right to make changes to the services and activities advertised for any reason and without notice
Any person using Lake 86s lake and facilities must complete, or have a valid risk acknowledgment completed on their behalf. Those participants under 18, or any other participant without their own valid Risk Acknowledgement, must ensure a legal guardian has fully completed on their behalf. Parties signing Risk Acknowlegments on behalf of younger customers state that they accept responsibility for the safety of themselves and for the supervision of children in their care.
Lake 86 retains the rights to refuse accommodation of participants that are deemed as unsuitable condition. This is in the interests of safety to self and others.
Customers take part in activities in the knowledge that participation is not without risk and serious misuse could be fatal.
Lake 86 does not accept responsibility for the loss or damage to any personal customer property whilst onsite. Lake 86 does not accept responsibility for loss or damage to customer vehicles. Vehicles and their contents are left at their owner's risk.
Lake 86 reserves the right to refuse admittance or to remove a participant from the premises should it be deemed necessary to do so. This includes any customer whose behaviour is considered antisocial and/or unsafe to themselves or others, or who is thought to be under the influence of alcohol or drugs. The decision of the Duty Manager on all matters of admittance will be final..
Lake 86 reserves the right to refuse admittance to any participant who is not dressed appropriately for the activity.
Lake 86 reserves the right to refuse entry or remove from the premises any person causing wilful damage to the facilities, fixtures, fittings or other property of Lake 86. Any party engaging in such behaviour will be liable to pay for the rectification, remedy and all damages caused. This includes any damage caused by misuse of equipment and/or failure to comply to supplied guidance and/or instructions.
For health and safety reasons and to allow for safe management of other customers Lake 86 reserves the right to refuse entry to late arrivals.
No refunds or compensation will be payable by Lake 86 in the event that any participant is not permitted to, refused permission or decides not to undertake or complete a session.

Prices and Payment

Lake 86 reserves the right to change its prices and tariffs at any time. As much notice as possible will be given should a change in price occur.

Refunds and Transfers

Lake 86 requires 7 clear days notice to provide a 50% refund.
Any amendments more than 48 hours clear notice will be offered a Credit. With less than 48 hours notice Lake 86 cannot offer cancellations a refund or transfer.

Memberships

Memberships when purchased will clearly show the membership type and start and end date of the membership in the order process.
Memberships can be paid in full at the time of purchase
Some Memberships can be paid for monthly. This will build a payment plan for you. This payment plan will clearly state what is due today and when the payments are due in the future and the amount to be paid on each day and how many payments their are.
This information will be shown in detail on the booking payment page. You will also be emailed it in the booking confirmation.

If you do pay for memberships monthly on a recurring basis. The website will email you 7 days prior to the payment being taken, reminding you that the amount of the payment and the date it will be taken.
On the payment date, your card will requested by the system and Truevo to take a payment of the agreed amount.
You will be send an email confirmation to confirm that payment was taken successfully or unsuccessfully.

If any unsuccessfull payment occurs then your membership will be ended automatically.
If you end your membership that terminates any future payments, but no refund will be given for any time the membership has been in place. You will not be able to resume your membership at a later date.

You can view, cancel your membership from your account area, when you login to the website.

By being a member you can then purchase member only activities on our website or at Lake 86

There are no membership trials.

Gift Vouchers

To redeem your Lake 86, Gift Voucher: Enter your Claim Code when prompted during checkout, or follow these steps:

If applied to your account; Gift voucher funds are automatically applied to eligible orders during the checkout process. You must pay for any remaining balance on your order with another payment method. You can also redeem your gift voucher for jump sessions at reception.

Lake 86 Gift Cards and Gift Vouchers ("GCs") may be used only for the purchase of eligible products on bookings.lake86.com or at our reception. GC balances must be used within 1 year of the date of purchase.GCs cannot be transferred for value or redeemed for cash. GCs are issued by Lake 86. Lake 86 is not responsible if a GC is lost, stolen, destroyed or used without permission. To redeem your GC, visit bookings.lake86.com or use them at our reception.

Club that the user is a member of, swimming or craft club.

Microsoft Account System
The website uses a Microsoft Account system in the website, to hold the accounts. This system is used is very robust/secure and is used in many websites.

Encryption/Decryption
We also encrypt/decrypt alot of your account data on the fly.

Site Certificate
Our site runs completely over https, which opens a secure encrypted web tunnel from your web browser to our server. The requests and responsese from the website are then transmitted over this tunnel.

Post code lookup
We use an address lookup system called Ideal Postcode we pass in a post code and it returns all addresses in that postcode. This saves time on you typing information in.

This is our legal basis Contract for GDPR. In GDPR you have to outline why we are collecting the information we are. We need this information so that you can book online and visit the centre.
We use your booking to make sure we don’t go over capacity at the park. For Health & Safety - we are only allowed so many people on sessions at a specific time. The capacity of a session depends on the type of session. This is all handled by the website. Your safety is our highest priority.

This is quite simply that you have read and agreed this notice and you know what your GDPR rights are.

By ticking the checkbox, you are agreeing to receive marketing emails. Lake 86 won’t spam you but from time to time, we may run a fantastic promotion and if you want us to let you know… By ticking (or unticking) this box, you can opt in or out of marketing emails. You can change this in your account at any time. Our marketing emails are also managed by Mail Chimp, and you can opt ourt of the marketing emails at anytime, by clicking the footer on the bottom of the emails.

For GDPR compliance we audit the changes to these checkbox’ and they can be viewed by our Administrators. The aim of this is not for user tracking, but just in case you question why you have received a service when you thought you hadn’t ticked the box.

Please be aware out system will send you Booking confirmation emails, waiver emails when you book. These won’t contain any marketing, they are just information, so you are aware of your booking. When we send you waivers we have removed out the personal information for your security.
Once registered you can edit your account.
You can change your details and password at any time, under my account details.

Party Information
We do collect extra information when you book a party. This is only used to provide the best party. The extra info is:-

Any special requirements including allergies/dietary requirements, so the party food is safe for all guests. We also need to know what activities you choose if there is a choce to be made.

Forgotten password
If you forget your password, then you can go through the forgotten password process when you click login.

Risk Acknowledgment
Waivers are linked to your account. Anyone who is taking part in any activity must have a Risk Acknowledgment. You can create a Rick Acknowledgment for you and your dependents. Depending upon the type of acitivity, the Risk Acknowledgement may just be for the account holder.
You can create Risk Acknowlegments at any time.
Risk Acknowledgments are valid for 12 months and we can search in our system for you and your dependents, to manage your booking.

Waiver Start and Finish Dates

Canoe And Kayak Store Paddlefest
We do NOT sell your data. But we have to pass some of your details to the Canoe and Kayak Store, due to your booking being with us and the event ran by Canoe And Kayak Store. If you choose not to share, as its optional then we will not pass your details.

SWIMPODIUM Timed Swim
We do NOT sell your data. But we have to pass some of your details to the timing company, in order for them to run the swim timings. This data will include, email address, first name and last name. The sponsor of the timings also is shared your email address for marketing purposes.

If our Privacy Policy/Terms and Conditions change over time.
On your next login, we will ask you to read and re-confirm that you are happy with them.
At this point you can also join/remove yourself from the Loyalty scheme and email marketing
We audit this change and can view it in our admin area. As part of GDPR we need to know what version of documentation you signed against.

Lake 86 uses Workspace to send and receive email to and from the centre.

Taking Payments
We pass information to Emerchant Pay gateway for payment. Email address, 1st name, last name and client address. This saves the user from retyping the info. Emerchant Pay are PCI DSS compliant payment provider.

Mail Chimp emails
The website sends a lot of email, too much for a Google G Suite service so we have to use a different mass email provider.
We use Mail Chimp Mandrill (Automated Services) to send our emails

Google Analytics

Like most websites, this site uses Google Analytics (GA) to track user interaction. We use this data to determine the number of people using our site, to better understand how they find and use our web pages and to see their journey through the website.

Although Google Analytics records data such as your geographical location, device, internet browser and operating system, none of this information personally identifies you to us. Google Analytics also records your computer’s IP address which could be used to personally identify you but Google do not grant us access to this. Google Analytic Opt out Browser Addin

In order to provide website visitors with more choice on how data is collected by Google Analytics, Google has developed the Google Analytics Opt-out Browser Add-on. CCTV
We have CCTV at the park for safety purposes and it is a requirement of our insurance company.

Insurance
If you have an accident at the park and we need to inform our insurance company then we need to pass your booking and account information to our insurance, plus any CCTV footage too. Plus any treatment/action required at the time of the accident.

How Long do we Keep the Data for?
Lake 86 keeps the account data forever so you can continue to book. However we do anonymise the data as per below:-
Bookings we will remove the booking from your account after 22 years and associate it with an anonymous user. So that we can’t trace the booking back to you.
Bookings contain waivers. These waivers will be associated with an Anonymous waiver after 22 years.
Risk Acknowledgments will expire for use after 12 months. At this point you can create a new one.

In GDPR however you do have rights as an individual that overrule the above. These are outlined below:-

Accessing your data
We recognise our responsibility in looking after your data. You can ask us for a copy of the data we hold, have it corrected, sent to a third party or deleted (subject to our need to hold data for legal reasons). We manage this process by executing a Data Subject Access Request procedures in line with GDPR requirements when you contact us. You can request a Data Subject Access Request Form by contacting us via our website our email.

We will respond within 30 calendar days of receipt of this DSAR. We also reserve the right to increase the response time to three months if we consider the request to be complex and time consuming. If you are not satisfied you have the right to contact the Information Commissioners Office (ICO).

The right to rectification;
You can edit your account details at any time, by logging into the website and altering the details. You can also alter your consents to the loyalty and email marketing scheme here too.
The only thing you cannot edit is your email address. This is for security. But we can edit it for you. If you need your email address changed, then please email info@lake86.com from the account registered with the system and we can change it for you.

the right to erasure;
If you want your account and waivers to be removed from the system then we can do that for you. Please email info@lake86.com from the account registered and we can start the process of removing you from the system.

the right to restrict processing;
As per above you can remove consents from email and loyalty system.
We can also mark your account as inactive. So that no one can log in or use your account. Please email info@lake86.com with your request from the account that is registered.

the right to data portability;
You can download some of your own account information from the My Account area of the system.
If you require any other data then please email the request to iinfo@lake86.com.

the right to object;
You have the right to object to any processing undertaken for the purposes of direct marketing. We will stop processing for direct marketing as soon as we receive your objection.

the right to not to be subject to automated decision making including profiling;
We do not supply the information we hold to third parties for use in analysis or prediction.

Data Breaches
As per GDPR we have a process in place and would follow the GDPR process notifying you if any data breach affected your data. We will do this in 72 hours of identifying the breach.

We also have our internal security policy for our staff on how to keep your data secure on electronic devices or any paper based information.

Cookies are small files that are downloaded to your browser from the website.
Lake 86 use cookies on our website, these cookies though are only used for authentication and to make our website function correctly. Google Analytics uses cookies too. But we don’t use cookies in any malicious way.
